Notice on Expanding the Scope of Implementation of the Policy on Government Procurement Supporting Green Building Materials for Building Quality Improvement

In order to implement the 'CPC Central Committee State Council on the complete and accurate implementation of the new development concept to do a good job of carbon peak carbon neutral opinions', to increase the procurement of green and low-carbon products, and comprehensively promote green buildings and green building materials, in Nanjing, Hangzhou, Shaoxing, Huzhou, Qingdao, Foshan and other six cities on the basis of pilot projects, the Ministry of Finance, Ministry of Housing and Urban-Rural Development, the Ministry of Industry and Information Technology has decided to further expand the support of the Government Procurement The Ministry of Finance, the Ministry of Housing and Urban-Rural Development, the Ministry of Industry and Information Technology has decided to further expand the scope of government procurement to support the implementation of the policy of green building materials to promote the quality of construction. The relevant matters are notified as follows:


一、Scope of implementation

Since November 2022, the policy of government procurement to support green building materials for building quality improvement has been implemented in 48 cities (municipal districts), including Chaoyang District of Beijing (including the previous 6 pilot cities, see Annex 1 for the list of specific cities). Projects included in the scope of implementation of the policy include hospitals, schools, office buildings, complexes, exhibition halls, convention and exhibition centers, gymnasiums, housing and other government procurement projects, including government procurement projects subject to the bidding and tendering law. Each relevant city may select some projects for early implementation, gradually expand the scope on the basis of summarizing experience, and achieve full coverage of policy implementation for government procurement engineering projects by 2025. Other government investment projects are encouraged to be included in the scope of implementation.


二、Main tasks

The cities concerned should deeply implement the idea of ecological civilization, actively promote the application of green buildings and green building materials by using government procurement policies, vigorously develop assembly, intelligent and other new types of industrialized building construction methods, comprehensively construct green buildings with more than two-star rating, form a long-term mechanism to support green and low-carbon transformation in the field of construction, lead the high-quality development of the building materials and the construction industry, and strive to build a livable, green and low-carbon city.

(一)Implementation of government procurement policy requirements. All relevant cities shall strictly implement the Government Procurement Requirements Standards for Green Buildings and Green Building Materials (hereinafter referred to as the Requirements Standards, see Annex 2) formulated by the Ministry of Finance, the Ministry of Housing and Urban-Rural Development and the Ministry of Industry and Information Technology. At the project establishment stage, the relevant requirements of the Demand Standards shall be embedded in the project proposal and feasibility study report; at the bidding and procurement stage, the relevant requirements of the Demand Standards shall be taken as the substantive requirements of the project bidding or procurement documents and the contract text, and the contracting unit shall be required to carry out the design and construction in accordance with the agreement of the contract, and to purchase or use the green building materials in compliance with the requirements; at the construction stage, the construction supervision shall be strengthened to ensure that the construction unit implements the green building requirements. In the construction stage, construction site supervision should be strengthened to ensure that the construction unit implements green building requirements and uses green building materials in compliance with the Demand Standard; in the performance acceptance stage, corresponding performance acceptance standards should be formulated in accordance with the Demand Standard and effectively integrated with the existing acceptance procedures. Projects that have passed acceptance are encouraged to declare green building labels, giving full play to the demonstration role of government procurement projects.

(二)Strengthening green building materials procurement management. Where government procurement projects included in the scope of policy implementation involve the use of green building materials in the Standards of Requirement, all building materials that comply with the relevant standards should be procured and used. All relevant cities shall explore the implementation of bulk centralized procurement of green building materials for general-purpose categories, and centralized government procurement agencies or departmental centralized procurement agencies shall regularly aggregate purchasers' procurement plans for green building materials, and carry out centralized band-volume procurement. To actively promote the green building materials electronic procurement transactions, all eligible green building materials products can enter the electronic platform transactions, improve the green building materials procurement efficiency and transparency. Suppliers of green building materials shall, at the time of supply, issue documents certifying that the building materials products they provide meet the demand standards, including the green building materials product certification that is uniformly implemented by the State, or valid test reports that meet the demand standards, and so on.

(三)Improvement of government procurement demand standards for green buildings and green building materials. Cities concerned may, taking into account the characteristics and actual needs of their regions, put forward proposals to optimize and improve the content of the Demand Standards, including adjusting the index requirements for building materials already included in the Demand Standards, increasing the demand standards for building materials not included in the Demand Standards, or refining the demand standards for different types of buildings, such as schools and hospitals, etc., and report them to the Ministry of Finance, the Ministry of Housing and Urban-Rural Development and the Ministry of Industry and Information Technology. The Ministry of Finance, the Ministry of Housing and Urban-Rural Development and the Ministry of Industry and Information Technology will dynamically adjust the Demand Standards in accordance with the recommendations of the cities concerned and the implementation of the policy.

(四)Priority is given to the settlement of project prices. For projects included in the scope of implementation of the policy, the proportion of project price settlement shall be increased, and the proportion of project progress payment shall be no less than 80% of the price of the completed project. To implement construction process settlement, the issuing and contracting parties agree through the contract to divide the construction process into construction cycles according to time or progress nodes, and to calculate, confirm and pay the price of the completed and undisputed works within the cycle. The process settlement documents confirmed by both parties are used as an integral part of the completion settlement documents and, in principle, will not be reviewed repeatedly after completion.


三、Work Requirements

(一)Clarify departmental responsibilities. The departments of finance, housing and urban-rural construction, and industry and information technology of the cities concerned shall perform their respective duties, strengthen coordination and cooperation, and form policy synergies. The finance departments shall organize purchasers to implement the Demand Standards, guide centralized purchasing agencies to carry out bulk centralized purchasing of green building materials, and strengthen the supervision and management of purchasing activities. Housing and urban-rural construction departments shall strengthen the supervision of engineering projects included in the scope of policy implementation, and cultivate demonstration projects for the application of green building materials and high-quality green building projects. Industry and information technology departments shall combine regional characteristics, develop the green building materials industry according to local conditions, and cultivate green building materials backbone enterprises and key products.

(二)Carefully organized implementation. Upon receipt of this Circular, the finance, housing and urban-rural development, and industry and information technology departments at the provincial level in which the cities concerned are located shall promptly forward it to the finance, housing and urban-rural development, and industry and information technology departments of the cities that have been included in the scope of implementation of the policy, so as to effectively strengthen the guidance of the work carried out in the cities concerned. The relevant cities should, in accordance with the policy requirements, study and formulate the implementation plan of the region, clarify the division of responsibilities of the relevant departments, improve the organization and coordination mechanism, and promptly study and properly deal with the problems arising in practice, so as to ensure that the expansion of the scope of implementation of the work to smoothly promote the work, and achieve solid results. It is necessary to actively summarize work experience and refine advanced experience and typical practices that can be replicated and promoted.

(三)Strengthening publicity and training. All relevant localities and departments should strengthen policy interpretation and publicity according to their respective responsibilities, respond to social concerns in a timely manner, and create a good working atmosphere. It is necessary to strengthen the policy interpretation and training of construction units, design units, building materials enterprises and construction units, and mobilize the enthusiasm of all parties concerned.
